Dutch National Jailed for 10 Years in Child Abuse Case in Kenya

A 73-year-old Dutch man was convicted of 10 counts involving child pornography and abuse, resulting in a 10-year prison sentence and Ksh3 million in fines. The Milimani Children’s Court sentenced a 73-year-old Dutch national to 10 years in prison after he was found guilty of multiple charges, including child pornography and child abuse. The Office of the Director of Public Prosecution (ODPP) confirmed that the man faced 10 counts: six for child pornography, two for sexual communication with a minor, one for committing an indecent act, and one for child abuse.
Evidence revealed that the suspect used WhatsApp to send obscene materials aimed at coaxing a 17-year-old boy into sexual activities. Furthermore, he was guilty of persuading a 16-year-old boy to engage in sexual communication with him, leading to unlawful physical contact that constituted sexual abuse while they were in a bed together.
Additionally, the suspect was implicated in encouraging a witness (PW3) to perform sexual acts with underage girls and instructed him to document these acts through nude photos and videos. These offenses were perpetrated between April 2022 and November 2023, according to the ODPP.
The presiding judge, Hon Alice Macharia, noted that the overwhelming evidence presented by the prosecution supported all charges beyond a reasonable doubt, emphasizing the testimony from the witness who displayed significant emotional distress. Alongside the prison term, the suspect was fined Ksh3 million as restitution.
Upon serving his sentence, the court ordered that the suspect be deported from Kenya. A total of nine witnesses contributed to the case, underscoring the severity of the offenses committed by the accused.
The Dutch national’s conviction highlights serious issues related to child abuse and pornography, emphasizing the legal system’s commitment to protecting minors. The successful prosecution, backed by strong evidence from multiple witnesses, resulted in a substantial prison sentence and financial restitution for the victims. Moreover, the deportation order reinforces the court’s stance against such egregious acts, ensuring the perpetrator does not pose a further threat to children in Kenya.
